Rejet de la question prioritaire de constitutionnalité Viagogo et Ticketbis

La société Viagogo, dont l’activité consiste notamment en la revente de billets sans autorisation des organisateurs, avaient soulevé une question prioritaire de constitutionnalité, dans le cadre d’un litige initié à son encontre par l’UEFA, afin d’écarter tout risque de sanction pénale. La société Ticketbis, dont l’objet est identique, s’était associée à cette demande.
Suite à cette demande, le Conseil constitutionnel a examiné l'article 313-6-2 du code pénal durant 3 mois afin de statuer. Le PRODISS est intervenu à la procédure en faveur de la constitutionnalité de cet article, dont il avait soutenu l’adoption en 2012. De nombreuses organisations se sont également mobilisées pour présenter leurs
observations :
L'Union Européenne des Associations de Football (UEFA), la Fédération Française de Rugby, la Ligue Nationale de Rugby, le Groupement d’Intérêt Public France 2023 (Comité d’Organisation de la Coupe du Monde de Rugby), la Fédération Française de Tennis, l’Association Nationale des Ligues de Sport Professionnel, Première Ligue, la Fédération Internationale de Football Association (Fifa) et la Société des Auteurs, Compositeurs et Editeurs de Musique (Sacem).
→DÉCISION DU 14/12/2018
Le Conseil constitutionnel, par décision du 14 décembre 2018, a jugé que l’article 313-6-2 du code pénal, qui sanctionne la vente de manière habituelle de titres d'accès à une manifestation sportive, culturelle ou commerciale ou à un spectacle vivant sans l’autorisation de l’organisateur de l’évènement, est conforme à la Constitution.
Les organisations mobilisées se félicitent de cette décision qui rejète la demande de Viagogo et de Ticketbis.
La spéculation sur le prix des billets pour les manifestations sportives ou culturelles, que permet l’activité de revente illicite, fait notamment obstacle aux efforts des producteurs de spectacles et des organisateurs pour démocratiser l’accès à leurs événements.
Par la désorganisation des réseaux de distribution des billets, cette activité illicite crée également des risques pour la sécurité et l’organisation des évènements eux-mêmes (répartition des supporters dans les enceintes sportives, prévention de l’accès des interdits de stade, annulation ou report des spectacles, etc…).
Seul l’achat de billets auprès de l’organisateur de la manifestation ou du revendeur agréé est de nature à garantir la sécurité des évènements sportifs et culturels, et à protéger le consommateur des nombreuses escroqueries liées à la revente illicite de billets.
Le PRODISS se félicite du rejet de la QPC, d’autant plus que le syndicat, aux côtés de plusieurs producteurs, a parallèlement engagé une action au pénal contre Viagogo. Le juge sera bientôt nommé. Rejection of the priority constitutionality question brought by Viagogo and Ticketbis
Viagogo, a company whose business consists mainly of marketing access rights to live shows without the authorisation of the live show organiser, raised a priority constitutionality question in a dispute brought against Viagogo by UEFA. Ticketbis, a company with the same illicit business model, joined this request.
Following this request, the French Constitutional Council examined article 313-6-2 of the French criminal code. PRODISS intervened in the proceedings in favour of the constitutionality of this article, which it had supported the adoption of in 2012. Numerous organisations also mobilised to present their observations: The Union of European Football Associations (UEFA), the French Rugby Federation, the National Rugby League, the “France 2023” Public Interest Group (Rugby World Cup Organising Committee), the French Tennis Federation, the National Association of Professional Sports Leagues, Première Ligue, the International Federation of Association Football (FIFA) and the French Society of Authors, Composers and Music Publishers (Sacem).
→ DECISION OF 12/14/2018
In a ruling dated December 14, 2018, the French Constitutional Council ruled that article 313-6-2 of the French criminal code, which penalises the marketing of access rights to sporting, cultural or commercial events or live shows, on a regular basis, without the authorisation of the live show organiser, is constitutional.
The organisations involved welcome this decision, which rejects the request made by Viagogo and Ticketbis.
Speculation on ticket prices for sporting or cultural events, which is facilitated by illegal marketing, hinders the efforts of producers and live shows organisers to democratise access to their events.
By disrupting ticket distribution networks, this illegal activity also creates risks for the safety and organisation of the events themselves (distribution of supporters in sports venues, prevention of access by those banned from stadiums, cancellation or postponement of shows, etc.).
Only the purchase of tickets to live shows from the event organiser or an authorised reseller can guarantee the safety of sporting and cultural events and protect consumers from the many scams associated with the illegal marketing of tickets.
PRODISS welcomes the rejection of the priority constitutionality question, especially since the union, alongside several live shows organisers, has simultaneously initiated criminal proceedings against Viagogo.
