  • de se voir remettre un faux titre d’accès ne permettant pas d’accéder au spectacle ;
  • de se voir remettre un simple duplicata d’un autre titre d’accès d’une personne ayant déjà accès à la salle ;
  • de payer pour un spectacle qui n’existe pas ;
  • de ne pas être informé si le spectacle est décalé ou annulé ;

Illegal marketing of access rights to live shows: legal action against passetonbillet.fr

Ekhoscènes has brought legal action before the Paris Court of Justice against the company Nito, the publisher of the website passetonbillet.fr, for its illegal practices in marketing access rights to live shows.

The website passetonbillet.fr artificially presents itself as a “ticket exchange platform for responsible fans”. This website lists many live shows (concerts, musicals, plays, etc.) and markets tickets without the authorisation of the live shows organisers.

However, the marketing of access rights to live shows, including via so called ”tickets exchange websites”, can only be done with the authorisation of the live shows organisers.

In France, article 313-6-2 of the French criminal code penalises the marketing of access rights to live shows without the authorisation of the live show organiser. The practices of these illegal operators also constitute parasitism and unfair competition causing harm to live shows organisers, as well as misleading commercial practices that are detrimental to consumers.

Ekhoscènes is asking the court to order Nito to cease its illegal activities and to order the company to compensate performing art professionals for the damages suffered.

For many years, Ekhoscènes has been defending performing art professionals by obtaining sanctions against illegal operators before courts.

A few reminders:

The ticket is the title that constitutes proof of the right to attend a live show. This access right is acquired by the spectator through a contract with the live show organiser. It is only valid if purchased from a distributor authorised by the live show organiser to market it.

Purchasing from an unauthorised operator carries many risks, including the risk not to be able to attend the live show and losing the money paid!

The consumer risks:

  • being provided with a fake access right that does not allow access to the show;
  • being provided with a mere copy of another ticket belonging to someone who already has access to the venue;
  • paying for a live show that does not even exist;
  • not being informed if the live show is postponed or cancelled;
  • not being reimbursed if the live show is cancelled.
